Terms of Service & Legal Covenant

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Driver", or "You") and DriveChinaNow ("Platform", "We", or "Us"). These Terms govern your access to and use of drivechinanow.com, including all published travel guides, GPS coordinate datasets, road trip dossiers, and planning inquiry desks.

If you do not unconditionally agree to all terms and conditions set forth herein, you are strictly prohibited from utilizing any materials, route files, or advisory content published on this platform.

DriveChinaNow operates strictly as an independent publisher of travel journalism, empirical road telemetry, and route engineering intelligence. We are:

• NOT a licensed travel agency or package tour operator under PRC Tourism Law;
• NOT a motor vehicle rental broker or franchised fleet operator;
• NOT a government agency, Public Security Bureau (PSB) branch, or Vehicle Administration Office (车管所);
• NOT an insurance underwriter or claim adjudication service.

All road descriptions, estimated travel durations, permit processing steps, and hotel lists are compiled for informative and educational planning purposes. Road conditions, pass open dates, and administrative regulations are inherently dynamic and subject to abrupt government alteration.

Western and southwestern China comprise some of the planet's most demanding alpine geography, with multiple national highway corridors exceeding 4,000 to 5,200 meters above sea level (e.g. G318, G219, G109). You expressly represent and warrant that:

• You have independently evaluated your physical health and medical fitness for high-altitude motor travel;
• You accept that acute mountain sickness (AMS), pulmonary edema (HAPE), and cerebral edema (HACE) are lethal risks that can impair driver judgment;
• You recognize that rockfalls, flash mudslides, blizzards, black ice, and remote mechanical breakdowns are natural hazards beyond human control;
• You assume sole, unshared physical, financial, and legal responsibility for any personal injury, death, vehicle damage, or travel interruption occurring during your journey.

While driving within the territory of the People's Republic of China, you are fully subject to PRC domestic laws. You agree to strictly abide by:

• Road Traffic Safety Law: Possessing a valid, physical Chinese Provisional Motor Vehicle Driving Permit (临时驾驶许可) before operating any motor vehicle;
• Frontier Defense Regulations: Securing all necessary Border Defense Permits (边防证) before traveling along designated border highway sectors (e.g. G219, G331);
• Military Control & Aerial Filming Prohibitions: Strictly respecting all roadside signage regarding military installations, sensitive radar facilities, and unmanned aerial vehicle (drone) flight bans;
• Foreign Visitor Hotel Registrations: Complying with foreign national accommodation rules where applicable.

DriveChinaNow accepts no liability for fines, detentions, vehicle impoundment, or entry visa revocations resulting from your failure to obey local law.

Any vehicle rental transaction you enter into with commercial fleet suppliers (including Zuche, eHi Car Services, Avis, or local regional car rental companies) is governed exclusively by your separate, bilateral contract with that supplier.

DriveChinaNow is not a party to your rental contract and exercises zero control over rental vehicle mechanical roadworthiness, pre-existing cosmetic damage, fuel policies, pre-authorization security deposit refunds, or traffic violation processing charges deducted by rental agencies.

All published content—including text, graphics, proprietary elevation profile charts, and structured coordinate dossiers—is the protected intellectual property of DriveChinaNow.

You are granted a limited, personal, non-commercial license to view and download route guides for your individual travel planning. You may not scrape, systematically copy, republish, resell, or ingest our proprietary route datasets into commercial training models without prior written permission.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DRIVECHINANOW, ITS DIRECTORS, EDITORS, RESEARCHERS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR RELIANCE ON ANY ROUTE, WAYPOINT, ELEVATION METRIC, HOTEL RECOMMENDATION, OR REGULATORY STATEMENT.

IN ANY EVENT, DRIVECHINANOW'S AGGREGATE FINANCIAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL BE STRICTLY CAPPED AT AND NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU DIRECTLY TO DRIVECHINANOW FOR BESPOKE DOSSIER PLANNING SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS LESS.

These Terms of Service are governed by and construed in accordance with the substantive laws applicable to digital information service platforms, without regard to conflict of law principles.
